Baltimore Circuit Judge Barry Williams will hold the hearing Wednesday afternoon in response to prosecutors’ request to force Officer Garrett Miller to testify against Officer Edward Nero.
Nero’s trial is scheduled to begin May 10.
Maryland’s highest court ruled last month that Officer William Porter, whose first trial ended in a mistrial, must testify against his colleagues while he awaits retrial.
Nero and Miller are among six officers charged in Gray’s death. Each faces assault, reckless endangerment and misconduct in office charges.
